Welcome to ClothsBuyMe.shop (“we,” “us,” “our,” or “the Site”). These Terms & Conditions (the “Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Customer”) and ClothsBuyMe.shop concerning your access to and use of our website, applications, services, and products sold via the Site (collectively the “Service”).

4. Orders, Pricing & Payment

1. Order Acceptance & Confirmation
   Your placement of an Order constitutes an offer to buy the Products. We reserve the right to accept or reject your Order in whole or in part, for any reason (e.g. out-of-stock, pricing error, fraud suspicion). If we reject your Order, we will notify you and refund any amount paid.
2. Pricing & Taxes
   All prices are shown in Indian Rupees (INR) or other currency as specified on the Site. Prices are inclusive/exclusive of Goods & Services Tax (GST) as applicable (state-specific). You are responsible for paying any applicable taxes, customs, duties, or import charges (if shipping internationally).
3. Payment Methods
   We accept payments via authorized payment gateways (e.g. credit/debit cards, net banking, UPI, wallet, etc.). We do not store your full card details; payment processing is handled by the payment processor. You agree to comply with the terms of such third-party payment providers.
4. Payment Authorization & Security
   By providing payment information, you represent and warrant that you are authorized to use that method and that the information is accurate. We reserve the right to put holds or refuse payment if we suspect fraud, illegal activity, or otherwise.
5. Order Cancellation / Modification by Customer
   You may request cancellation or modification of an Order before it has been dispatched. Once the Order has been dispatched, cancellation or modification is not guaranteed and will be subject to our Return / Refund Policy.

5. Shipping, Delivery & Title

1. Shipping & Delivery
   We will arrange to ship your Products in accordance with our Shipping Policy (or as specified on the Site). Delivery times are estimates only and may vary. Delays do not entitle you to compensation, except where required by law.
2. Risk & Title
   Title and risk of loss or damage to Products pass to you upon delivery (i.e. when the carrier delivers the Products to your specified address). Until such time, we or our freight provider retain title.
3. Inspection & Acceptance
   Upon delivery, you should inspect the Products immediately. If the Product is damaged or defective, you must inform us within a specified time (as per our Return & Refund Policy). Failure to do so may waive certain claims.

6. Returns, Refunds & Cancellations

Your rights relating to returns, refunds, and cancellations are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Please review that policy to understand the conditions, timelines, and procedures. In case of conflict between these Terms and the Return & Refund Policy, the latter governs for refund / return matters.

7. Disclaimers, Warranties & Limitation of Liability

1. No Warranty
   The Service and Products are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory or otherwise. To the fullest extent permitted by law, we disclaim all implied warranties including fitness for a particular purpose, merchantability, non-infringement.
2. Accuracy & Errors

However, errors, inaccuracies, or omissions may occur (e.g. typographical errors, pricing errors). We reserve the right to correct such errors—even after you place your Order—and to cancel or refuse Orders based on such errors.

8. Indemnification

You agree to indemnify, defend, and hold harmless ClothsBuyMe.shop and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your breach or violation of these Terms;

9. Suspension & Termination

1. Termination by Us
   We may suspend or terminate (in whole or part) your access to the Service at any time, with or without cause, and without liability or notice. Upon termination, all rights granted to you under these Terms immediately cease, and you must cease all use of the Service.
2. Effect of Termination
   Upon termination, sections regarding Intellectual Property, Payments, Disclaimers, Indemnification, Limitation of Liability, Governing Law, etc., shall survive.
3. Customer Termination
   You may stop using the Service at any time. If you have an Account, you may request its deletion (subject to pending obligations).
